Privacy Notice
Last updated: September 23, 2026
People have a right to know what's in the water they drink. You also have a right to know what happens to your information. This Privacy Notice explains what Aquagenuity® collects, why, and the choices you have.
This notice covers aquagenuity.com and its sub-sites, the Guardian Declaration and enrollment pages, the AquaReady™ hub and app, AquaAlert™, and any other website, app or service that links to it (together, the "Services"). It is provided by Aquagenuity Inc. and Aquagenuity Foundation Inc. ("Aquagenuity®," "we," "us"). Aquagenuity Inc. runs our technology, data, products and apps. Aquagenuity Foundation Inc. runs Guardians of H2O™ community and school programs. Each is responsible for the information it collects for its own activities.
This notice doesn't cover third-party websites we link to, or our employees (who are covered by internal policies).
Summary
- We don't sell your personal information. We don't rent it or trade it for marketing either.
- We collect information from three places: what you give us, what we collect automatically when you use the Services, and what we receive from partners such as schools.
- We use it to run the Services, send you your water information and alerts, run Guardian programs, improve AquaScore™, and keep the Services safe.
- Water data is different from personal data. We license water-quality data and insights to others. That licensed data never includes your name, email, phone number or exact home address.
- Children under 13 take part only through a teacher or a parent. We don't let children under 13 sign up on their own.
- You're in control. You can ask to see, correct, download or delete your information, and you can unsubscribe from emails or texts at any time.
1. Information we collect
Information you give us
- Contact details: name, email address, phone number, and zip code, for example when you check your AquaScore™, sign the Guardian Declaration, download a guide, or join our newsletter.
- Your address: if you use address-based features such as AquaReady™ Local Reports or Address Watch, we collect the address you choose to monitor.
- Guardian submissions: water test results, photos, notes and observations you submit, along with the time, place and device information that proves where and when a sample was taken (our "chain of custody").
- Reports: water problems you report through AquaAlert™, including descriptions and photos.
- Purchases: order and shipping details for kits, boxes and add-ons. Payment card details go directly to our payment processor; we don't store full card numbers.
- School and organization details: if you nominate a school, register a classroom, or reach out as a sponsor, city or partner.
- Messages to us: anything you send to hello@aquagenuity.com or through our forms.
Information we collect automatically
- Device and usage data: browser type, device type, pages viewed, links clicked, referring site and approximate location from your IP address.
- Precise location: only when you allow it, for example to tag a Guardian water sample. You can turn this off in your device settings.
- Cookies and similar tools: see Section 9.
Information from others
- Schools and teachers who set up classroom accounts for students.
- Parents who set up accounts for their children.
- Service providers that help us run the Services (for example, email, forms and payment providers).
- Public sources: public water-quality, utility and permit records. These are about water systems and places, not about you.
2. How we use information
- To provide the Services: show your AquaScore™ and The AquaGap™ for your area, send guides and reports, run the AquaReady™ hub and app, and fulfill orders.
- To send alerts and updates you ask for, including AquaAlert™ notices and the "What's In Your Water" newsletter.
- To run Guardians of H2O™ programs, including the Declaration, missions, badges, school programs and events.
- To build and improve AquaScore™ and our water models, using water data and de-identified or aggregated information.
- To route AquaAlert™ reports to people who can help, such as your local utility or city, when you ask us to.
- To keep the Services secure, prevent fraud and abuse, and verify the chain of custody of water samples.
- To follow the law and respond to lawful requests.
We don't use your personal information to make decisions about you that have legal or similarly significant effects.
3. How we share information
We share personal information only in these situations:
- Between Aquagenuity Inc. and Aquagenuity Foundation Inc., so Guardian programs and the technology that powers them work together.
- With service providers who work for us under contract, such as website hosting, email delivery, forms, payments, shipping, labs that test water samples, and analytics. They may use your information only to provide services to us.
- With your school, if you take part through a classroom account.
- When you ask us to, for example sending your AquaAlert™ report to your utility or city.
- For legal reasons, to comply with law, protect rights and safety, or respond to valid legal process.
- In a business transfer, such as a merger or acquisition, where the new owner must honor this notice.
4. Water data and licensing
Water data is the heart of what we do. We combine public records with results from Guardians and labs to score water across the country, and we license water data and insights to organizations such as researchers, companies and governments.
- Licensed data is about water and places, not people. It never includes names, emails, phone numbers or other contact details.
- Results from homes are shown and licensed at a generalized location (for example, a neighborhood or water-system area), never as an exact home address.
- Photos you submit are not licensed with any personal details attached.
5. Children, students and schools
- We don't knowingly let children under 13 create accounts on their own. Children under 13 take part only through a teacher-managed classroom account or a parent-managed account.
- Classroom accounts: a school may authorize our Services for educational use on behalf of parents. We use student information only for that educational purpose, never for advertising, and we don't sell it.
- Parents can ask to review or delete their child's information, or stop further collection, by emailing hello@aquagenuity.com.
- If we learn we've collected personal information from a child under 13 without proper consent, we'll delete it.
- Teens 13 to 17 should use the Services with a parent's or guardian's awareness.
6. Text messages (SMS)
If you sign up for texts, such as AquaAlert™ notices, you agree to receive recurring automated text messages from Aquagenuity® at the number you provide. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time, or HELP for help. We don't share your mobile number or text-message consent with third parties for their marketing.
7. Your choices and rights
- Email: unsubscribe with the link in any email.
- Texts: reply STOP.
- Location: turn off location access in your device settings.
- Your data: you can ask us to show you, correct, download or delete your personal information. Email hello@aquagenuity.com with the subject "Privacy request." We'll confirm your identity and respond within the time the law requires (usually 30 to 45 days).
- Account deletion: you can delete your AquaReady™ account in the app or by emailing us. We'll delete your personal information unless we must keep it by law. Water results you submitted may remain in our data without your identity attached.
- State privacy rights: depending on where you live, you may have extra rights, such as appealing a decision about your request. We honor these rights and won't treat you differently for using them. We don't sell or "share" personal information for cross-context behavioral advertising.
- Switzerland, the EU and the U.K.: you may also have rights to object to or restrict our processing and to complain to your local data protection authority. Where required, we rely on your consent, our contract with you, our legitimate interests in running and improving the Services, or legal obligations.
8. How long we keep information
We keep personal information only as long as we need it for the purposes in this notice, to meet legal obligations, or to resolve disputes. Then we delete or de-identify it. De-identified water data may be kept indefinitely because it is the scientific record.
9. Cookies and similar tools
We use cookies and similar tools to keep the Services working, remember your choices (for example, the last zip code you checked), and understand how the Services are used. You can block or delete cookies in your browser settings; some features may not work without them. We don't use cookies to sell your information.
10. Security
We use reasonable administrative, technical and physical safeguards to protect your information, including encryption in transit. No system is perfectly secure, so please use a strong password and keep it private.
11. International visitors
Aquagenuity® is based in the United States and also has an office in Switzerland. Your information may be processed in the United States and other countries whose laws may differ from yours. Where required, we use legal safeguards for these transfers.
12. Changes to this notice
We'll update this notice as the Services grow. We'll change the "Last updated" date and, for major changes, tell you by email or a notice on the site.
