Terms of Use
Last updated: September 23, 2026
These Terms of Use ("Terms") are an agreement between you and Aquagenuity Inc. and Aquagenuity Foundation Inc. ("Aquagenuity®," "we," "us"). They cover aquagenuity.com and its sub-sites, the Guardian Declaration and enrollment pages, the AquaReady™ hub and app, AquaAlert™, and any other website, app or service that links to them (the "Services"). By using the Services, you agree to these Terms and to our Privacy Notice. If you don't agree, please don't use the Services.
Summary
- Our water information helps you ask better questions. It is not medical, legal or engineering advice, and it doesn't replace your utility's official notices.
- In an emergency, call 911. For urgent water problems, contact your water utility directly.
- When you submit water results or photos, you keep ownership, and you give us permission to use them to score and protect water.
- Be truthful and respectful. Report facts, not accusations.
- Our brands, content and technology belong to Aquagenuity®.
1. Who can use the Services
You must be at least 13 to create your own account. Children under 13 may use the Services only through a teacher-managed classroom account or a parent-managed account. If you use the Services for a school, company, city or other organization, you confirm you have authority to accept these Terms for it.
2. Your account
Keep your login details private and tell us right away at hello@aquagenuity.com if you think your account has been misused. You're responsible for activity on your account. You can delete your account at any time in the app or by emailing us.
3. Water information, AquaScore™ and The AquaGap™
- AquaScore™, The AquaGap™, Local Reports, alerts and other water information are provided for general information and education. Some scores are modeled from public data and some are measured from test results. We label which is which.
- Water quality changes over time. Information may be incomplete, delayed or wrong, and a result for an area may not match the water at your tap.
- Health goals and legal limits come from public sources such as the U.S. Environmental Protection Agency. We report the data and the limits. We don't declare any specific utility's water safe or unsafe.
- Don't rely on the Services alone for decisions about your health, your family's health, property purchases or legal matters. Talk to a doctor, a certified lab, your utility, or a qualified professional.
4. Guardian submissions
When you submit water test results, photos, notes or other content ("Submissions"):
- You keep ownership of your Submissions.
- You give Aquagenuity® a worldwide, royalty-free, perpetual, irrevocable, transferable and sublicensable license to use, copy, analyze, combine, display and share your Submissions, and data derived from them, to score water, improve our models, run Guardian programs, publish findings and license water data. We'll handle any personal information in them as described in our Privacy Notice, including never licensing your exact home address or contact details.
- You confirm your Submissions are yours to share, collected honestly, and not altered.
- Stay safe and stay legal. Collect samples only where you have the right to be. Never enter private property, restricted sites, or data-center property to collect a sample.
5. Reports and community rules
When you report a water problem through AquaAlert™ or post anything in the Services:
- Report facts, not accusations. Describe what you saw, where and when. Don't claim that a named person, company or utility broke the law unless it's in a public record you can link to.
- Don't post anything false, threatening, harassing, hateful, private (such as someone else's personal information), or that violates anyone's rights.
- Don't post content that promotes violence, trespass or property damage.
We may review, edit for safety, decline or remove any content, and suspend accounts that break these rules. We may share reports with utilities, cities or authorities who can help.
6. Corrections
Accuracy matters to us. If you think any information in the Services is wrong, email hello@aquagenuity.com with the subject "Correction," and tell us what's wrong and why. We review every request and fix verified errors.
7. Purchases
- Prices, what's included, shipping and refund terms are shown at checkout and form part of these Terms.
- Pre-orders show an expected ship date. If we can't ship, you can cancel for a full refund.
- Test kits must be used as instructed. Home test strips are screening tools, not certified lab results.
- Purchases made through the Apple App Store or Google Play are also governed by that store's terms, and refunds for those purchases are handled by the store.
8. Text messages
If you sign up for texts, the SMS terms in our Privacy Notice apply. Reply STOP to cancel or HELP for help. Message and data rates may apply.
9. Our content and brands
The Services, including AquaScore™, The AquaGap™, AquaReady™, AquaAlert™, AquaHub™, Guardians of H2O™, Water-as-a-Service™, the Aquagenuity® name and logo, our software, data, models, designs and text, belong to Aquagenuity® or our licensors and are protected by law. You may view and share our public pages for personal, non-commercial use with credit to Aquagenuity®. You may not copy, scrape, resell, reverse-engineer or build a competing product or dataset from the Services without our written permission. Data licensing requests: hello@aquagenuity.com.
10. Acceptable use
Don't misuse the Services. For example, don't: break the law; interfere with or overload the Services; access them by automated means (including scraping and AI training) without permission; try to access accounts or data that aren't yours; or submit fake or manipulated water results.
11. Third-party services and links
The Services may link to or use services we don't control, such as payment processors, app stores, video players and news websites. Their terms and privacy policies apply to your use of them.
12. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON'T GUARANTEE THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
13. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, AQUAGENUITY INC., AQUAGENUITY FOUNDATION INC. AND THEIR OFFICERS, DIRECTORS, EMPLOYEES AND PARTNERS WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. SOME PLACES DON'T ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.
14. Indemnity
If you break these Terms or the law, or your Submissions or reports cause a claim against us, you agree to cover our reasonable losses and costs from that claim.
15. Governing law
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Fulton County, Georgia, unless the law where you live requires otherwise.
16. Changes and ending access
We may update these Terms as the Services grow. We'll change the "Last updated" date and, for major changes, tell you by email or a notice on the site. We may suspend or end access for anyone who breaks these Terms. You can stop using the Services at any time.
